Below are the Terms of Use on which Japan World offers you our JPAL service.

Welcome to Japan World's Terms of Use for the JPAL service. JPAL is an advertisement/profile service offered by Nozomi Enterprises (QLD) under the domain name www.japanworld.com.au and will be referred to as JPAL throughout these Terms of Use and Privacy Policy. These Terms of Use prescribe the policies that govern the use of our JPAL service. To use the services of JPAL you must read and accept the Privacy Policy and Terms of Use. The Privacy Policy and Terms of Use can be amended at our own discretion and you agree to be notified of any amendments via your registered email address. Amendments of the Privacy Policy and Terms and Conditions will be effective ten (10) days after the notification email has been sent by JPAL. If you do not agree with the amendments you must remove all advertisements/profiles and terminate your membership before the amendments take effect.

1. Account Eligibility

To register as a member and/or use the services of JPAL you must:

• Read and accept the Terms of Use as stated by JPAL
• Read and accept the Privacy Policy as stated by JPAL .
• Be at least 18 years of age or over.
• Agree to be notified of service announcements by JPAL via your registered email address.
• Maintain valid contact information.
• Not use and/or view this service in a country and/or location that deems the content of the JPAL service to be in violation of local laws and/or customs.
• Agree to view content that is classified as R18+

2. Submitting Information

When registering as a member and/or submitting an advertisement/profile the information you submit must not:

• Contain false or misleading information.
• Be fraudulent.
• Contain items that deceptively represent a genuine item.
• Contain items that are stolen.
• Contain items that do not possess a written agreement to be sold on your behalf by a third party.
• Breach any third party copyright, trademark, intellectual property or proprietary rights.
• Use any image to which you are not the sole owner or do not have written model release rights.
• Use any image that contains background persons that are identifiable unless you have their written release to use the image in an unlimited capacity.
• Contain any child pornography.
• Violate any applicable laws and regulations.
• Contain any information that is defamatory, racially discriminating, threatening or harassing.
• Contains any information that is deemed to be in violation of the Broadcasting Services Act 1992. (This information may be obtained from the Australian Broadcasting Authority website at http://www.aba.gov.au).
• Contain any malicious computer generated activity such as Viruses, Trojans, Spyware, Worms or Bots that interfere with the serviceability of the website or information contained within the website.
• Link to or reference any other website in the Forum or Guest areas of JPAL.
• Link to or reference any other website that breaches the Terms of Use as stated by JPAL.

By submitting your information you grant JPAL all rights both known and unknown to display your information in a publicly worldwide manner. This will avoid JPAL from violating any rights you may possess in the content of the information you submitted. All information submitted is subject to and will not breach the Privacy Policy of JPAL.

3. Fees

There are no fees associated with creating a JPAL membership. A nominated fee will apply if you wish to become a paying member and participate in categories that require you to be a paying member to respond to advertisements/profiles or view other members details. Fees are paid before being granted access to paying member facilities and when a paying membership expires there are no automated reoccuring fees. Paying member access is granted manually to ensure all payment of fees is complete and access is granted normally within 24 hours.

4. Buying

JPAL does not warrant or guarantee any item advertised using the JPAL service. Members are to use their own judgement when purchasing an item from another member. JPAL recommends that members only purchase items from members that are willing to receive payments via Paypal or Bank Deposit. JPAL does not participate in dispute resolution between members that purchase items from other members.

5. Selling

To advertise and sell an item you must be able to do so without infringing any laws. The information included in an advertisement must be relevant to that item including your description of that item and your full conditions of sale for that item. To ensure confidence of other members JPAL recommends that you accept Paypal or Bank Deposit payments. JPAL does not participate in dispute resolution between members that sell items to other members.

6. Liability

JPAL shall not be held liable for lost profits or damages of any kind that result from the use of our services including negligence. You agree that JPAL is not responsible for the lawful actions of yourself and other members.

7. Warranty

• You agree that when buying or selling using JPAL services that JPAL is not associated or responsible for any warranty or guarantee on any item or service purchased or sold from another member. All warranties or guarantees on any item or service offered by you must be clearly stated in your auction with reference to the extent of claim, expiry time and transferability of the warranty or guarantee.
• JPAL cannot guarantee the authenticity of any content submitted to JPAL therefore members should exercise their own judgement and caution when responding to advertisements/profiles. JPAL does not recommend that members reveal personal information to other members.

8. Indemnification

You agree to indemnify JPAL from any claim or third party claim arising from your or any third party violation of these Terms of Use or any applicable laws and regulations.

9. Our Service

• JPAL is a service offered to assist members in responding to advertisements/profiles from a variety of categories . JPAL is unable to regulate the content and accuracy of an advertisement/profile or that members will conduct their actions in a lawful manner.
• The services supplied to you by JPAL is in an as is condition. JPAL does not guarantee a service that is constant and securely accessible as many factors beyond our control may contribute to an interrupted service. The services offered to you by JPAL do not associate you with us as employees, employers, partners or contractors.

10. Breach of Terms and Conditions

JPAL reserves the right at its own discretion to implement warning, suspension and termination of your account if you are in breach of these Terms of Use, Privacy Policy or any applicable laws and regulations.
